MansioSec Subscription and License Terms

These terms cover your subscription to MansioSec. They're written in plain English on purpose. If anything here is unclear, email jeff@jcady.org before you subscribe.

1. Who we are

MansioSec is provided by JCady LLC, an Arizona limited liability company ("JCady", "we", "us"). "You" means the firm or person that subscribes. If you subscribe for a firm, you confirm that you're allowed to accept these terms for it. The people you add to your firm's account ("your users") use MansioSec under your subscription, and you're responsible for their use of it.

2. Your license

• While your subscription is active and paid, we give you a non-exclusive, non-transferable license to use the MansioSec tools to deliver your own consulting services to your own clients.
• Seats are named users. Each seat is one named person with their own login and second step. Logins may not be shared. When someone leaves your firm, you can remove them and give the seat to someone else.
• No resale or redistribution. You may not sell, sublicense, rent, share or redistribute the MansioSec software, its templates, question sets, mappings or other content, or offer them as your own product or service. You may not copy the tools out of MansioSec to run elsewhere, or reverse engineer them except where the law allows it.
• We (and our licensors) keep all rights in MansioSec that these terms don't expressly give you.

3. Your work belongs to you

The reports, assessments, registers, policies, playbooks and other deliverables you make with MansioSec, and the client information in them, belong to you and your clients. You may give deliverables to your clients, and they may use, copy and change them for their own organization. Where a deliverable includes our template wording, you and your client may keep using that wording as part of that deliverable, including after your subscription ends. [attorney to confirm]

4. Client data

• The tools run in your browser. Client information you enter is kept in your browser and in the files you export, on your own devices. It isn't sent to us, and we can't see it, recover it or back it up. Keeping those files safe, backed up and protected is your responsibility.
• What MansioSec does store: your account (each user's email address, role and last-used date, and for a free trial the name and website you gave); your firm's details (name, plan, seats, dates, billing email, and the Stripe customer and subscription references); the branding your firm saves (name, contact details, colors, logo and where visitors' results should go); and your team list.
• Visitors' results from your free website tools: when a visitor chooses to send their results and your firm has no form of its own, MansioSec emails them to you and keeps no copy (only short-lived counters that limit abuse).
• Service providers: sign-in is handled by Auth0, payments by Stripe (we never see or store card numbers), and email by Resend.

5. Acceptable use

You and your users agree not to:

• use MansioSec for anything unlawful, or to assess or test systems you aren't authorized to;
• try to get around sign-in, licensing or security controls, or reach another firm's account or data;
• share logins, or add people who aren't part of your firm;
• scrape, copy in bulk or automate access to MansioSec, or use it to build a competing product;
• put your free website tools on sites that aren't yours, or present them in someone else's name;
• upload anything harmful, such as malware, or anything you don't have the right to use (for example, a logo that isn't yours).

6. Your responsibilities

• Professional judgment. MansioSec is a set of tools for professionals. The advice and deliverables you give your clients are yours, and you're responsible for them.
• Agreement templates are starting points. Have your own attorney review any agreement, statement of work or policy template before you use it. MansioSec doesn't provide legal advice.
• Check the framework mappings. The crosswalk between frameworks (such as NIST CSF 2.0 and the CISA Cross-Sector Cybersecurity Performance Goals) is our own mapping, not an official one, so verify it for your client's situation. MansioSec isn't affiliated with or endorsed by NIST, CISA or any government agency.
• No promised outcomes. MansioSec doesn't promise insurance coverage, approval or premiums, or any certification, compliance or audit result.

7. Fees, renewal and cancellation

• Plans and prices are on the pricing page. You pay in advance, monthly or yearly, through Stripe. Any tax is shown at checkout.
• Your subscription renews automatically at the end of each period until you cancel.
• Cancel anytime, from Manage billing in the app or by emailing jeff@jcady.org. Your access continues until the end of the period you've paid for, then the tools stop opening.
• No refunds for partial periods, except where the law requires one. [attorney to confirm]
• If a payment fails, Stripe tries again. Your tools stay open for a few days past the end of the paid period while it does; if no payment succeeds, they stop.
• We'll tell you by email at least 30 days before a price change applies to your next renewal.

8. Free trial

• A free trial lasts 7 days, needs no card, and is one per firm (and one per email address). It covers the Practice plan's tools for one person.
• At the end of the trial the tools stop opening unless you subscribe. Your setup (team and branding) is kept for 30 days, then deleted. Your free tools for your website go live once you subscribe.
• Nothing is charged for a trial, and it never turns into a paid plan without you choosing one.

9. Founding-member pricing

The founding-member code FOUNDING50 gives 50% off the first 12 months of a subscription, on any plan. It's for the first 10 firms that use it, once per firm, and can't be combined with other offers. After those 12 months, the plan's regular price applies at renewal. If you cancel, the discount ends with the subscription.

10. Availability and support

• We work to keep MansioSec available and secure, but we don't offer a service-level agreement or promise that it will always be available or free of errors. We may take it offline for maintenance.
• Support is by email at jeff@jcady.org, on a reasonable-effort basis.
• We improve MansioSec over time and may change or retire tools. Because your work is in your own files, export it regularly.

11. Warranty disclaimer

For attorney review. MansioSec is provided "as is" and "as available". To the fullest extent the law allows, JCady LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of liability

For attorney review. To the fullest extent the law allows, JCady LLC's total liability for any claim relating to MansioSec or these terms is limited to the fees you paid for MansioSec in the 12 months before the event that gave rise to the claim. JCady LLC isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if told they were possible.

13. Suspension and ending

We may suspend or end access for a firm or user that breaks these terms or doesn't pay, and we'll tell you why. When a subscription ends, the tools stop opening; your exported files stay with you. We delete a firm's account records within a reasonable time after it ends, except records we must keep, such as billing records. [attorney to confirm]

14. Governing law

These terms are governed by the laws of the State of Arizona. Any dispute will be heard in the state or federal courts located in Maricopa County, Arizona. [attorney to confirm]

15. Changes to these terms

We may update these terms. For a material change, we'll email your firm's owner or show a notice in the app at least 30 days before it takes effect. If you don't agree with a change, you can cancel before it takes effect; continuing to use MansioSec after that means you accept it.

16. Privacy

Summary (draft). MansioSec has no separate privacy policy yet. In short: we collect only what's listed in section 4 (account, firm, branding, team and billing references) to run your subscription, sign people in and send service emails; we don't sell personal information or use client data, which never reaches us. We use Auth0, Stripe and Resend to provide the service, and a cookie-free page counter (GoatCounter) on the public pages. To ask about or delete your information, email jeff@jcady.org.
